Ford Mustang Shelby GT350 owners sue company on "track-ready" claim


Owners of three 2016 Shelby GT350 Mustangs with the Technology Package filed a class action lawsuit against Hagens Berman law firm Wednesday against Ford Motor Company. When the owners took their cars off the track, they experienced overheating transmissions and differentials that sent the Mustangs into a low-power "flabby mode" to avoid damage. The main issue of owners is that Ford has announced the GT350 as "Track-Ready" regardless of the equipment, and so the car entering blur mode on track does not support this claim.

The suit goes on to allege that the Ford transmissions and differentials installed in the base and the GT350s package-equipped technology, which lacked the transmission trackbox and differential coolers, were clearly faulty as they did not live up to the claims Of the car and its components "Track-Ready". As a result, the trial said Ford violated not only the false advertising laws, but the warranty laws, since the company did not replace or modify the existing proprietary drivetrains with components that could handle runway time.

The law firm cites various advertisements, press releases, and even a Ford-sponsored track-day driving education. It also raises complaints from Mustang forums about transmission and differential problems on race tracks. We saw a YouTube video demonstrating the problem, which was featured on AllFordMustangs.com. The lawsuit alleges that Ford knew it was an issue, and quotes the inclusion of chillers as standard equipment on all 2017 models. It should be noted that it was not just Ford's cooling equipment made standard for 2017, however. This equipment became standard on all GT350s with everything else in the track package, which included magnetorheological shocks, a frame tower splinter, and a larger rear spoiler.

Owners are looking for monetary restitution, a recall of affected vehicles, and a redemption option.

The Dearborn, MI automaker responded in a statement: "Ford is committed to providing our customers with first-class vehicles. However, we do not comment on pending litigation.
